Terms & Conditions

1 THESE TERMS AND CONDITIONS

1.1 These are the Terms and Conditions on which we supply and instal fitted furniture products to consumers. These terms do not apply to customers seeking to purchase products in the course of their business, they apply only to retail/end user customers.

1.2 Please read these terms carefully before you confirm and submit your order to us. These terms tell you who we are, how we will provide products to you and other important information.

2 INFORMATION ABOUT US AND HOW TO CONTACT US

2.1 Medford Media Walls is a trading name of BPDO Ltd (“the Company”): BPDO Ltd is a company registered in England and Wales with company registration number 08827643.  The registered address for the Company is 126 High St, Marlborough, Wiltshire, SN8 1LZ

Throughout these Terms and Conditions, the Company is also referred to as “we”, “us” and “our”.

2.2 You can contact us by

2.3 Our website will guide you through the order process and you will be given the opportunity to review your design and confirm all aspects of your order in writing (usually via email) before we submit it to our third-party manufacturer.  Please ensure you have checked all aspects of your order carefully before confirming it in writing.

2.4 Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and the Company. Our acceptance and order confirmation will normally include the following information:

  1. an order number;
  2. confirmation of the products ordered including full details of the main characteristics of those products; and
  3. estimated installation date(s).

3 DESIGNING YOUR FITTED FURNITURE

3.1 Our team and design software tools will enable us to create your own bespoke design for your fitted furniture based on measurements agreed by you and the Company. When creating your project, you need to ensure that the placement of your furniture will allow it to operate as intended. For example, opening drawers or cupboards will not be restricted by other fixed items, such as radiators, light fittings, doors or other fitted furniture.

3.2 You are responsible for agreeing the measurements for any space(s) where fitted furniture is intended to will be installed by the Company.

3.3 While our design team will make every attempt to correctly interpret your requirements and the dimensions that you have been taken, it is your responsibility to check and confirm design prior to purchase.

3.4 We accept no responsibility for any errors with the design arising from measurements supplied by you as the customer and no refunds will be offered in those circumstances.

3.5 Please note that all purchases will be machined to the dimensions specified within the mutually agreed design. Dimensions of items manufactured will be accurate to +/- 5mm.

3.6 We make all reasonable efforts to ensure that all descriptions and images of wood and materials available from us on our website match the actual goods, however images on our website should not be relied upon to be a totally accurate representation of any material as they are for illustrative purposes only.

3.7 We use several colours and finish types to create beautiful looking fitted furniture. You can choose from a variety of colours and finishes via our website or by requesting a free colour swatch sample. Colours or patterns may ever so slightly differ in certain batch runs which is the norm within the industry, we will not be responsible if very slight deviations are visible.

3.8 We will not carry out an in-depth site survey, take measurements outside of those required for the product design, or offer/provide opinions or advice on structural or other building related matters. You therefore agree that the following shall apply:

  1. we will work exclusively from the information about and measurements of the specific product design that you formally confirm acceptance of;
  2. you will be solely responsible for warranting the accuracy of all such information and measurements;
  3. where such information or measurements are materially incorrect, and as a result the design and installation is inappropriate for your space in any material respect, or, where we provide fitting and/or supply products, we order or supply materials or products whose size, type, or quantity is wrong as a result of us using such materially incorrect information or measurements, you agree that you will bear any resulting additional costs and expenses for altering, re-making or replacing those materials or products or other error rectification work.

4 PRICE AND PAYMENT

4.1 Pricing is inclusive of VAT and will be confirmed as accepted by you at the time of order.

4.2 All orders must be paid for in full at the point in which you confirm your order, unless we have agreed another payment method.

4.3 Any designs and quotations provided are valid for 30 days, however you acknowledge that during this 30-day period prices are subject to change as we constantly monitor material costs.

5 DELIVERY

5.1 The delivery and shipping elements within any overall quotation are valid for 30 days, however you acknowledge that during this 30-day period prices are subject to change as we constantly monitor shipping and delivery costs.

5.2 If we need to deliver any additional items due to an error on your part with the confirmed measurements, and/or if you change the scope of your order, we may have to charge for delivery on these items.

5.3 We will not be responsible for delays in delivery or delays caused by damaged items in delivery. Nor will we be responsible for inconvenience due to delay.  Any items that are damaged/lost during the delivery phase will be replaced as soon as is practically possible.

5.4 We will use reasonable endeavours to schedule a delivery date with you within 14 days of receiving your confirmed order.

5.5 Access to the property is required for up to a 7.5m vehicle to park without obstructing the road. Deliveries can take place on any day between 7.00am and 7.00pm. We will always advise on the scheduled delivery time slot.

5.6 It is your responsibility to make sure someone is available to accept your delivery. If our driver arrives within the estimated delivery slot given to you but nobody is available to accept delivery, then additional charges will apply.

5.7 On occasions, goods maybe difficult for our driver to unload alone and you agree to assist, or organise others to assist, in these circumstances. If assistance is not available from anyone at the delivery location, we reserve the right to charge a reasonable additional amount to arrange for a driver’s assistant.

6 INSTALLATION

6.1 If during the order process you have selected installation by the Company, or a third-party installing on behalf of the Company, we will fit the products we supply to you together with any items supplied by you which we have agreed to be covered by our installation service.

6.2 It is important that during the order confirmation process before you provide final confirmation in writing, you confirm the location of your project and whether it is to be installed in anything other than a ground floor location. Failure to notify us will mean you a liable for an additional charge as our fitter will incur additional time dissembling items for your project if the location is anything other than ground floor.

6.3 You agree:

  1. to make sure that the installer has access to the site at reasonable times (between 8:00am and 7:00pm on weekdays excluding public holidays) or otherwise as agreed by you and us;
  2. to make sure that any re-routing or installation of electrics and removal of existing furniture have been carried out to a good workman-like standard prior to the install date;
  3. to provide reasonable access to the room to be fitted to clear the room to provide sufficient working space for the fitter and co-operate in reducing health and safety risks to an acceptable level.

6.4 You confirm that you have told us of any particular features which you know about the space or its construction which may make the installation more difficult than we might reasonably expect.

6.5 Please note that we will not fit any fitted furniture onto carpet. You agree that our installer is permitted to peel back any carpet when furniture is to be fitted and acknowledge that upon completion of the installation it is your responsibility to arrange for the excess carpet to be cut back and refitted around the newly fitted furniture.

6.6 You acknowledge that you have checked the walls are sound.

6.7 Whilst we will try to ensure our installers keep dust and disruption to a minimum during the provision of the installation services, you should take all reasonable and necessary steps to minimise the impact, for example by moving breakables/delicate items and covering areas likely to be affected with dust sheets. Whilst our installers will endeavour to clean up after themselves, you should expect some dust to result from the installation services and you agree that we will not be liable for any cleaning expenses resulting from such dust. 

6.8 On completion of the installation, you agree to sign a certificate of completion and allow the installer to take photographs of the completed works for both reference and marketing purposes.

6.9 If for any reason you are not satisfied with the install and feel that the installer cannot rectify the issue, please, contact us in writing with your concerns.

7 QUALITY

7.1 Because the materials supplied are measured specially for your order, it is not possible to return it if not suitable. If materials arrive damaged or we have made an error(s) with your order, we will repair or replace it as soon as possible.

7.2 Please check your materials carefully and report any problems immediately on delivery as we will not be held liable for visible defects identified after receiving a signed acceptance of delivery or after the install has been completed.

7.3 We will not be held liable for conditions of use or storage within a customer’s premises after delivery which may affect the materials in any way.

7.4 We warrant that fitted furniture that we supply is guaranteed against material failure for a period of 10 years from completion of installation. At our discretion we shall repair, replace or reinstall parts as required. This is subject to the following:

  1. you having properly cared for and used the goods and followed any instructions provided by us;
  2. the fitted furniture having not been altered, repaired or modified in anyway.

7.5 The warranty implied in guarantee in 7.4 does not cover the following:

  1. any damage caused by natural wear and tear;
  2. natural colour fading caused by prolonged exposure to direct sunlight;
  3. fitting of any small item replacements, for example, handles etc;
  4. electrical and light fittings;
  5. accidental damage caused because of an unexpected and non-deliberate action; or
  6. any fitting issues reported outside of 30 days from original installation date.

7.6 If we supply you with an accompanying item not manufactured by our manufacturer, you acknowledge that any warranty or guarantee given to you in respect of that item is given by the third-party manufacturer, not the Company. We do not accept any guarantee or warranty claim for goods not supplied by our fitted furniture manufacturer.

8 CANCELLATION

8.1 Please note that due to the goods being bespoke to you, we do not offer a refund or cancellation of the goods after we have confirmed receipt of confirmed order from you.

8.2 When you select to confirm your order and make payment, we immediately order the wood materials and start the machining process. At this point we have incurred costs, and we would not be able to refund anything other than the installation if you have selected the installation option.

9 LIABILITY

9.1 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; or breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982.

9.2 If your project is for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

9.3 We will not be responsible for redecorating or making good any damage unless it is because of our negligence rather than an unavoidable consequence of having the products fitted, in which case our liability will be limited to the total price charged for the products and installation service.

10 OTHER IMPORTANT TERMS

10.1 We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

10.2 You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

10.3 This contract is between you and the Company. No other person shall have any rights to enforce any of its terms. Neither you or the Company requires the agreement of any other third party to end the contract if there has been a breach or make any changes to these terms.

10.4 Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

10.5 If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

10.6 These terms are governed by the laws of England and Wales and both you and the Company agree to submit to the exclusive jurisdiction of the English courts.
